Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Validrive website or platform (the "Service") operated by Validrive ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, Founders, Testers, and others who access or use the Service.

2. Description of Service

Validrive is a community-led distributed testing platform that connects founders launching projects ("Founders") with real individuals providing rapid feedback ("Testers"). We provide the infrastructure for Founders to list projects, and for Testers to review, test, and offer feedback on those projects.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

  • Founders: You are responsible for ensuring that any project or product you submit for testing complies with all applicable laws and does not infringe on third-party rights.
  • Testers: You agree to provide honest, constructive, and accurate feedback. You must not use automated scripts or bots to generate feedback or bypass our testing protocols.

4. User-Generated Content and Intellectual Property

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content").

  • Founder Content: Founders retain all intellectual property rights to their projects and the original materials they provide. By uploading your project, you grant Validrive and its approved Testers a limited license to access and test the project solely for the purpose of providing feedback.
  • Tester Feedback: Testers grant Validrive and the respective Founder a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute the feedback, comments, and bug reports submitted through the platform.

5. Prohibited Activities

You agree not to engage in any of the following activities:

  • Using the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Harassing, threatening, demeaning, or promoting violence against others.
  • Interfering with or disrupting the security, integrity, or performance of the Service.
  • Attempting to reverse engineer, decompile, or extract the source code of any software provided on Validrive or by a Founder.

6. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Validrive makes no warranties regarding the accuracy of feedback provided by Testers or the success, functionality, or marketability of any products tested by Founders.

7. Limitation of Liability

In no event shall Validrive, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
